The Health Insurance Portability and Accountability Act of 1996. Among other issues, HIPAA allows for employees to move from one employer to another without losing coverage for pre-existing conditions. At Montana State Fund, we often receive requests from medical providers to enter into business associate agreements in accordance with the regulations adopted under HIPAA.

MSF Exemption. The workers’ compensation system is an "exempted" benefit" under the HIPAA privacy regulation. This means that workers’ compensation carriers such MSF are exempt from all HIPAA privacy requirements. A covered entity may disclose a patient’s health care information to MSF, without violating HIPAA privacy rules. Thus, the HIPAA regulations will not impact or disrupt the way workers’ compensation claims are administered or paid.
